What most agencies miss about AI use

Could you be breaching a client contract by using AI without realising it? I had an eye opening chat with Ryan and Kay from law firm Hybrid Legal - and realised agencies might be inadvertently exposing themselves to risk.

Where's the risk?

Ryan and Kay shared a couple of agency examples:

  • If you’re using an AI notetaker to record meetings it could be storing confidential client data outside the UK/EU - which may be in breach of a confidentiality clause contained in the contract you have with your client (if you don't disclose it).

  • If your freelance designers/copywriters are using AI (without you knowing), many tools don’t allow users to transfer ownership of generated content - so you may not legally be able to pass those rights on to your client.As Ryan said:

“The issue isn’t whether you should use AI, it’s whether you understand what you’re using and what you’ve agreed to.”

Here are some takeaways and action steps the team shared:

1. Audit your tools

If you don't have a company-wide AI use policy, team members may be using personal AI accounts. Have an open conversation with the whole team about how AI is being used.

2. Check privacy settings and know where data is stored

If data is stored outside the UK/EU, you may be breaching data laws so check the AI tool settings and also check your client contract T&Cs - particularly IP and data privacy clauses.

3. Disclose AI use to clients

Some client contracts require you to get permission before using AI so if you haven't already, have the conversation with clients about their AI policy and yours. Update your contracts with an AI disclosure clause.This chat was packed with useful tips and sound advice. Listen to the episode here.
